Terms of Use

1. Acceptance and eligibility

You may use the Site only if you can form a binding contract under applicable law and are not barred from using it. The Site is intended for a general adult audience. If you use the Site on behalf of an organization, you confirm you have authority to bind it to these Terms.

2. No investment, tax or legal advice

Everything on the Site, including quotes, charts, screeners, market mood indicators, calendars, news headlines, book recommendations and any other content, is provided for general information and educational purposes only. It is not, and should not be construed as, investment advice, a recommendation, a solicitation or an offer to buy or sell any security, cryptocurrency, commodity or other instrument, or tax, legal or accounting advice.

Investz is not a broker-dealer, investment adviser, financial planner or tax professional, and using the Site does not create an advisory, fiduciary or client relationship between you and Investz. Your circumstances, goals and risk tolerance are unique. Before making any financial decision, do your own research and consider consulting a licensed professional who knows your situation.

Investing and trading involve substantial risk, including the possible loss of all the money you invest. Past performance does not guarantee future results. Day trading, leveraged products, options and crypto-assets can be especially risky and are not suitable for everyone.

3. Market data, news and calculations

• Delayed and possibly inaccurate. Prices, charts and other data come from third-party providers and may be delayed, incomplete, adjusted, cached or wrong. Do not rely on the Site for time-sensitive trading decisions. Confirm prices with your broker or the relevant exchange before you act.
• Proxies. Where a data source does not supply an index or futures price, we may show the price of a related exchange-traded fund as a stand-in. Labels on the page say when this is the case. A proxy can differ from the actual index or commodity price.
• Derived figures. Indicators such as the Investz Market Mood gauge, movers lists, screener results and portfolio gain/loss are simple calculations from available data. They are not forecasts or recommendations, and they may contain errors.
• News. Headlines come from public feeds and link to the original publishers. We do not write, verify or endorse that content.
• Earnings and economic calendars. Dates, times and estimates are supplied by third parties and may change or be incomplete.

4. Watchlist and portfolio tools

The watchlist and portfolio tools store your entries in your own browser. They are hypothetical, for tracking and learning only, and are not connected to any brokerage account. We cannot recover entries if you clear your browser data or change devices. Values shown are estimates based on the data described above and may not match your actual holdings or statements.

5. Acceptable use

You agree not to:

• use the Site in violation of any law or regulation, or to infringe anyone’s rights;
• scrape, crawl, harvest or systematically download data from the Site by automated means, other than ordinary search-engine indexing that respects our robots.txt;
• resell, redistribute, sublicense or commercially exploit the Site’s data, content or tools without our written permission, or present them as your own;
• overload, disrupt or interfere with the Site, its servers or networks, or attempt to bypass rate limits, caching or security measures;
• probe, scan or test the vulnerability of the Site, or attempt unauthorized access to it or related systems;
• introduce malware or other harmful code, or use the Site to send spam or deceptive content; or
• use the Site’s content to make or imply false claims about Investz, such as an endorsement.

We may block or limit access to anyone we reasonably believe is violating these rules or putting the Site at risk.

6. Intellectual property

The Site’s design, layout, text, code, graphics and the Investz name and logo are owned by Investz or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use.

Third-party names, logos, trademarks, headlines, book titles, cover art and data belong to their respective owners. Their appearance on the Site does not imply affiliation with or endorsement by those owners, except where we state a relationship (for example, our participation in the Amazon Associates Program). Market data providers and publishers may have their own terms for the data and content they supply.

If you believe content on the Site infringes your copyright, email hello@investz.com with enough detail to identify the work and the material, your contact information and a statement that you are authorized to act, and we will review it promptly.

7. Feedback

If you send us suggestions or feedback, you agree we may use them without restriction or compensation to you.

8. Third-party links, embeds and affiliate relationships

The Site contains links to, and embeds from, third-party websites and services, including TradingView, news publishers and Amazon. We do not control them and are not responsible for their content, accuracy, availability or practices. Your use of them is at your own risk and subject to their terms.

Some links, including book links, are affiliate links. We may earn a commission on qualifying purchases at no extra cost to you. See our Disclosures. Any transaction is between you and the third party. We are not a party to it and do not handle payment, shipping or returns for items sold elsewhere.

9. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Investz disclaims all warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement and uninterrupted or error-free operation. We do not warrant that the Site or its data will be accurate, current, secure or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, Investz and its owners, operators, contributors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or investment value, arising out of or related to your use of or inability to use the Site or your reliance on its content, even if advised of the possibility of such damages. This includes losses from trading or investment decisions.

To the extent liability cannot be excluded, our total liability for all claims relating to the Site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify and hold harmless Investz and its owners, operators and service providers from claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

12. Availability, changes and termination

We may modify, suspend or discontinue any part of the Site, including features, data sources and tools, at any time without notice. We may suspend or terminate your access if you violate these Terms or if we need to protect the Site or others. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. You and Investz agree that any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their personal jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. Before filing a claim, you agree to try to resolve the dispute informally by emailing hello@investz.com.

14. General

These Terms, together with our Privacy Policy and Disclosures, are the entire agreement between you and Investz about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of the Site.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version. Continuing to use the Site after changes take effect means you accept the updated Terms.
